各(ge)省、自治區、直轄(xia)市教(jiao)育(yu)廳(教(jiao)委)、版權(quan)局(ju),新(xin)疆生產建設兵團教(jiao)育(yu)局(ju)、版權(quan)局(ju),有關部(bu)門(單位)教(jiao)育(yu)司(局(ju)),部(bu)屬(shu)各(ge)高等學校(xiao),部(bu)省合建各(ge)高等學校(xiao):
為貫(guan)徹落實《國務院辦(ban)(ban)公廳(ting)關于印發政府機關使用正版軟(ruan)件管理辦(ban)(ban)法的(de)通(tong)知》(國辦(ban)(ban)發〔2013〕88號(hao)),進(jin)(jin)一步完善教育(yu)系統(tong)軟(ruan)件正版化(hua)(hua)工作長效(xiao)機制(zhi)(zhi),推進(jin)(jin)教育(yu)系統(tong)軟(ruan)件正版化(hua)(hua)工作規范化(hua)(hua)、常(chang)態化(hua)(hua)、制(zhi)(zhi)度化(hua)(hua)。現就有關事(shi)項通(tong)知如下。
一、總體要求
以(yi)習近(jin)(jin)平(ping)新(xin)時代中(zhong)國(guo)特色社會主(zhu)義思想為指導,深入貫徹黨的(de)(de)二(er)(er)十大和二(er)(er)十屆二(er)(er)中(zhong)、三中(zhong)全(quan)會精神(shen),認真落(luo)實(shi)習近(jin)(jin)平(ping)總(zong)書記(ji)關于知識產權工(gong)作(zuo)的(de)(de)重要論述,全(quan)面(mian)落(luo)實(shi)全(quan)國(guo)教育大會精神(shen),充分發(fa)(fa)揮推(tui)進(jin)使用(yong)正版軟件工(gong)作(zuo)對維護信息安全(quan)、發(fa)(fa)展新(xin)質(zhi)生(sheng)產力(li)、推(tui)動數(shu)字經濟(ji)高(gao)質(zhi)量發(fa)(fa)展的(de)(de)重要作(zuo)用(yong),為教育強(qiang)國(guo)、網絡強(qiang)國(guo)、知識產權強(qiang)國(guo)、數(shu)字中(zhong)國(guo)建設提供(gong)有力(li)支撐(cheng)。
2027年底前,教(jiao)育(yu)系統(tong)(tong)軟(ruan)件(jian)正(zheng)(zheng)版化工(gong)作長(chang)效(xiao)機制基本建(jian)立(li),教(jiao)育(yu)系統(tong)(tong)軟(ruan)件(jian)正(zheng)(zheng)版率(lv)顯著提升,全面使用正(zheng)(zheng)版操作系統(tong)(tong)軟(ruan)件(jian)、辦公軟(ruan)件(jian)和殺毒軟(ruan)件(jian),使用未經軟(ruan)件(jian)著作權(quan)人授權(quan)的(de)軟(ruan)件(jian)情(qing)況基本杜絕。教(jiao)育(yu)系統(tong)(tong)工(gong)作人員、教(jiao)師、學(xue)生(sheng)版權(quan)保護意識普遍增強,尊重(zhong)和保護知識產(chan)權(quan)成為(wei)師生(sheng)的(de)自覺行動。
二、工作要求
(一)健(jian)全工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)機(ji)制。各(ge)地各(ge)校(xiao)要(yao)從維護信息安全、激發創新(xin)活力、營造(zao)創新(xin)環境和助推(tui)人才培(pei)養(yang)的高(gao)度,充分(fen)認(ren)識軟件(jian)正(zheng)(zheng)(zheng)版(ban)化工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)的重大意義。要(yao)將軟件(jian)正(zheng)(zheng)(zheng)版(ban)化工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)與教育數字化、網絡安全、信息技術應用創新(xin)等工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)相銜接,整(zheng)體設計、一體推(tui)進,建(jian)立健(jian)全本單位軟件(jian)正(zheng)(zheng)(zheng)版(ban)化工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)管(guan)理制度,明(ming)確(que)責(ze)(ze)任(ren)分(fen)工(gong)、工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)要(yao)求和工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)程(cheng)序,壓實(shi)工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)責(ze)(ze)任(ren)。要(yao)結合本地本校(xiao)實(shi)際,制定軟件(jian)正(zheng)(zheng)(zheng)版(ban)化工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)實(shi)施方(fang)案,明(ming)確(que)工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)目標、重點任(ren)務和舉措,確(que)保軟件(jian)正(zheng)(zheng)(zheng)版(ban)化工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)扎(zha)實(shi)有序開展。
(二)嚴格(ge)采(cai)(cai)(cai)購(gou)(gou)管(guan)理。各(ge)地(di)各(ge)校要(yao)(yao)按照(zhao)政(zheng)府采(cai)(cai)(cai)購(gou)(gou)計算機(ji)軟硬件的(de)相關(guan)政(zheng)策規定,建(jian)立健全軟件采(cai)(cai)(cai)購(gou)(gou)管(guan)理機(ji)制(zhi),規范采(cai)(cai)(cai)購(gou)(gou)流程,落(luo)實辦公終端以及正版(ban)軟件集中采(cai)(cai)(cai)購(gou)(gou)要(yao)(yao)求。要(yao)(yao)強化軟件采(cai)(cai)(cai)購(gou)(gou)源頭管(guan)理,新購(gou)(gou)置(zhi)的(de)辦公終端應預裝或配套采(cai)(cai)(cai)購(gou)(gou)正版(ban)操作系(xi)統軟件、辦公軟件和殺毒軟件。鼓勵各(ge)地(di)根據(ju)政(zheng)府采(cai)(cai)(cai)購(gou)(gou)相關(guan)規定合(he)理降低軟件采(cai)(cai)(cai)購(gou)(gou)成本。
(三)規范使(shi)用管理。各地各校要制(zhi)定軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)資(zi)產管理制(zhi)度(du),規范軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)登記、配置(zhi)、使(shi)用、維護(hu)、處(chu)置(zhi)等環(huan)節(jie)的(de)(de)管理,防止因機構調整、人員變動(dong)、系統軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)版(ban)本(ben)升級、設備更新等因素,造成軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)授(shou)(shou)權(quan)失效、資(zi)產流失。要全面(mian)排查(cha)本(ben)單位操作(zuo)系統、辦公(gong)軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)、殺毒軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)和工(gong)業軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)采購(gou)、授(shou)(shou)權(quan)和使(shi)用情(qing)況,建立軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)資(zi)產管理臺(tai)(tai)賬(zhang),每(mei)半(ban)年開(kai)展一(yi)次(ci)軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)資(zi)產清查(cha)和許可證核查(cha),動(dong)態(tai)更新軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)資(zi)產信(xin)息,做到(dao)軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)實際(ji)安裝(zhuang)使(shi)用情(qing)況、軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)資(zi)產臺(tai)(tai)賬(zhang)和軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)授(shou)(shou)權(quan)采購(gou)協(xie)議相一(yi)致。有條件(jian)(jian)(jian)(jian)的(de)(de)地區和學(xue)校要利用信(xin)息化手段(duan),提高軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)正版(ban)化工(gong)作(zuo)的(de)(de)質量和效率。
(四)擴大推(tui)(tui)廣(guang)應用。各地要統籌考慮區域(yu)、城鄉、校際(ji)差異(yi),針對不同類型(xing)、不同學(xue)段學(xue)校特點(dian)(dian)(dian)和實際(ji)需求,分類推(tui)(tui)進教育系統軟件(jian)正版(ban)化(hua)工作(zuo),優先做好(hao)中小學(xue)、中職學(xue)校的正版(ban)軟件(jian)配備,重點(dian)(dian)(dian)督促高等學(xue)校率先完成工作(zuo)目標。各地可(ke)結合本地實際(ji)情況,選擇軟硬件(jian)基礎較好(hao)、師生知識產權意識較強的學(xue)校進行試點(dian)(dian)(dian),總結推(tui)(tui)廣(guang)經驗,以點(dian)(dian)(dian)帶面(mian),穩(wen)步推(tui)(tui)進。
(五)深化產(chan)學合(he)(he)(he)作。各地教育(yu)部(bu)門(men)、高等(deng)學校和軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)(jian)企(qi)(qi)業(ye)要(yao)形成合(he)(he)(he)力(li),建(jian)立(li)供需對接機制,促進軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)(jian)人(ren)才培養(yang)和產(chan)業(ye)發(fa)展。鼓(gu)勵地方(fang)教育(yu)部(bu)門(men)制定優惠政策,支持(chi)校企(qi)(qi)合(he)(he)(he)作項目(mu)。高等(deng)學校要(yao)充分發(fa)揮人(ren)才和科(ke)研(yan)(yan)(yan)優勢,與軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)(jian)企(qi)(qi)業(ye)共建(jian)實(shi)驗(yan)室、研(yan)(yan)(yan)發(fa)中心等(deng)創新平臺,開展聯合(he)(he)(he)攻關,提升自主研(yan)(yan)(yan)發(fa)軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)(jian)供給能力(li)。督促軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)(jian)企(qi)(qi)業(ye)根據各地各校實(shi)際需求,研(yan)(yan)(yan)發(fa)適(shi)用于教學、科(ke)研(yan)(yan)(yan)的正(zheng)版軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)(jian)產(chan)品和解決方(fang)案。支持(chi)軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)(jian)企(qi)(qi)業(ye)創辦軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)(jian)生(sheng)態(tai)賽事,搭建(jian)產(chan)學研(yan)(yan)(yan)用交流平臺,鼓(gu)勵教師、學生(sheng)積極(ji)參與軟(ruan)(ruan)(ruan)件(jian)(jian)(jian)(jian)(jian)賽事活動,在壯大(da)生(sheng)態(tai)中做好人(ren)才培養(yang)工(gong)作。
(六)加強(qiang)(qiang)宣(xuan)(xuan)傳(chuan)(chuan)教(jiao)育。各地各校要(yao)將軟件正版(ban)化納入教(jiao)育數字化、網絡安(an)全(quan)等相關工(gong)作宣(xuan)(xuan)傳(chuan)(chuan)內容(rong),充分利用世界知(zhi)識(shi)(shi)產(chan)權日(ri)、國家安(an)全(quan)教(jiao)育日(ri)、國家網絡安(an)全(quan)宣(xuan)(xuan)傳(chuan)(chuan)周等重要(yao)時間節點,廣泛開展有特色、有實效和(he)有針對性的宣(xuan)(xuan)傳(chuan)(chuan)活動,普及軟件版(ban)權知(zhi)識(shi)(shi),增強(qiang)(qiang)教(jiao)師、學(xue)生使用正版(ban)軟件的意識(shi)(shi)和(he)習(xi)慣。定期開展軟件正版(ban)化工(gong)作專題培訓,加強(qiang)(qiang)工(gong)作交流(liu),不斷提升(sheng)教(jiao)育系(xi)統各級(ji)工(gong)作人員的版(ban)權意識(shi)(shi)和(he)業務(wu)能力。
三、保障措施
教育部(bu)(bu)門應加入各級(ji)推進(jin)使(shi)用(yong)(yong)正版(ban)軟(ruan)(ruan)(ruan)件(jian)工作(zuo)機(ji)制,指(zhi)導(dao)本(ben)地(di)(di)區教育系(xi)統使(shi)用(yong)(yong)正版(ban)軟(ruan)(ruan)(ruan)件(jian)工作(zuo)。各地(di)(di)各校要(yao)明(ming)確牽頭職能(neng)部(bu)(bu)門,合理(li)安排資(zi)(zi)金,加強日常監管,督促(cu)軟(ruan)(ruan)(ruan)件(jian)企業嚴(yan)(yan)格履行合同,提(ti)供優質產品(pin)和服(fu)務(wu),建(jian)立問題反饋和服(fu)務(wu)響應機(ji)制。教育部(bu)(bu)將配(pei)合國家版(ban)權局等部(bu)(bu)門,每年開展正版(ban)軟(ruan)(ruan)(ruan)件(jian)使(shi)用(yong)(yong)情(qing)況督查檢(jian)查工作(zuo),對(dui)結果(guo)予(yu)以通報(bao);對(dui)軟(ruan)(ruan)(ruan)件(jian)正版(ban)化工作(zuo)推進(jin)不力(li),情(qing)節嚴(yan)(yan)重(zhong)的(de),予(yu)以約談問責。省(sheng)級(ji)教育行政(zheng)部(bu)(bu)門要(yao)積極爭(zheng)取地(di)(di)方政(zheng)府支(zhi)持,加大對(dui)中(zhong)小(xiao)學校的(de)支(zhi)持力(li)度,對(dui)經(jing)濟欠發達地(di)(di)區給(gei)予(yu)傾(qing)斜,縮(suo)小(xiao)地(di)(di)區差(cha)距。鼓勵社(she)會(hui)力(li)量參與,吸引社(she)會(hui)資(zi)(zi)本(ben)投入,多渠道籌措資(zi)(zi)金,形成(cheng)穩定(ding)的(de)經(jing)費保障機(ji)制。
